Kursus ini merupakan pengenalan asas terhadap dua bidang ilmu fiqh yang utama yang merangkumi fiqh ibadat dan munakahat dan ditawarkan dalam satu subjek. Ia membincangkan hukum-hukum asas dalam ibadah berkaitan bersuci, solat, zakat, puasa, haji dan umrah, juga permasalahan kontemporari yang berkaitan dengannya. Bahagian kedua pula menyentuh kepada perbincangan aspek-aspek yang berkaitan munakahat seperti pernikahan, rukun-rukun nikah, syarat-syarat pernikahan juga kesan undang-undang, sosial dan agama terhadap perkahwinan. Bahagian kedua ini juga membincangkan permasalahan talak, khulu’, fasakh, juga perkara-perkara yang berkaitan. Perbincangan difokuskan kepada metodologi fiqh al-Syafie, yang menjadi mazhab utama di dalam pengamalan aspek ibadat dan munakahat di Malaysia. Di samping penelitian juga dilakukan terhadap pandangan mazhab-mazhab yang lain kepada beberapa isu yang terpilih.

RATIONALE FOR THE INCLUSION OF THE COURSE/MODULE IN THE PROGRAMME:

LAC5262 is an elective subject for SMFF program. Students who choose Law package in the program are required to register for this subject.  Undang-undang Siber represents an integral component in understanding laws. Therefore, an understanding of matters related to cyberlaw, cybercrime is a must for those student who choose law package.

SYNOPSIS:

 

This subject is an elective subject for SMFF program. Cyberlaw provides recent legal development on media such as the Internet, issues of online copyright, intellectual property, cyber crime, data protection, privacy and other legal issues to cyberlaw. Therefore, an understanding of legal matters related to cyberlaw is a must before relate to Syariah matters.

تتناول هذه المادة مقدمة علم أصول الفقه من حيث تعريفه، وتاريخ نشأته وفوائد تعلّمه وتدوينه وطريقة الأصوليين فيه. وتركّز أيضا على المباحث الأصولية المتعلقة بالحكم الشرعي من بيان حقيقته وأقسامه بالتفصيل وهي الحكم التكليفي والوضعي، وكذلك العزيمة والرخصة، كما تعنى المادة أيضا ببيان المباحث المتعلقة بالحاكم ومسألة التحسين والتقبيح، والمحكوم فيه وهو فعل المكلف، والمحكوم عليه وهو المكلف ومباحث أهليته، وعوارض الأهلية

This part of the course embarks with the concept of federalism under which some related topics will be discussed, among others the Malaysian structure of federalism, the relationship between federal and state government and their jurisdiction under the Constitution. Besides,
the constitutional amendments and fundamental liberties such as the liberty of the person, freedom of speech and right to education and property will also be focused. The position of Islam as the official religion, special provisions of the Malays, national language and citizenship are also discussed. Other focuses of the course are emergency powers, special powers against subversion and contemporary issues of the constitution. Decided cases are of primary importance to this course.
This course deals with the legal aspects of Islamic finance including its practices in Malaysia. It exposes the students to the regulatory frameworks of Islamic finance, which centred on examination of relevant statues, case law, and jurisdiction of the courts and the role of Shariah advisory council. Thae main statutes introduced in this course are Islamic Financial Services Act 2013, Capital Market and Services Act 2007 and Central Bank of Malaysia Act 2009 (Act 701). Apart from that, this course will deal extensively on the jurisdiction of the courts and the decided cases relating to Islamic banking and finance. As an addition to the content of the course, this course will also briefly expose the students the concept of takaful, types of takaful and the laws relating to it. As an addition to the content of the course, this course will also expose the students to the concept of al-Rahnu and Islamic securities and the laws relating to the areas.

LAB4102 is an elective subject for SmFF program. Students who chose Islamic Finance package in the program are required to register for this subject. Islamic Banking, Takaful and al-Rahnu represents an integral component in the Islamic financial structure. Therefore, an understanding of matters related to Islamic banking, Takaful and al-Rahnu is a must for Islamic finance student.
